Terms of Service

Welcome to ShopByVideo. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before creating an account or posting a bounty.

1. Who We Are

ShopByVideo is an online marketplace that connects brands ("Brands") with video creators ("Creators"). Brands post bounties — paid requests for video content — and Creators submit videos in response. ShopByVideo facilitates the transaction between both parties.

2. Eligibility

You must be at least 18 years old to use ShopByVideo. By creating an account you represent that you meet this requirement and that all information you provide is accurate and current.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must not share your login, impersonate another user, or create accounts for any purpose other than legitimate use of the platform. ShopByVideo reserves the right to suspend or terminate accounts that violate these Terms.

4. Brands — Posting Bounties

When you post a bounty you agree to:

• Pay the full bounty amount plus applicable fees at checkout via Stripe before the bounty goes live.
• Review submitted videos in a timely manner.
• Not reject submissions in bad faith to avoid paying creators.
• Only request content that is legal and does not violate the rights of any third party.

Funds are held by ShopByVideo until a submission is approved. Approved payouts are released to the creator's connected Stripe account. Unused funds from unfulfilled bounties may be returned as account credits at ShopByVideo's discretion.

5. Creators — Submitting Videos

When you submit a video you agree that:

• You own or have the right to use all content in the video, including music, footage, and any third-party material.
• You grant the Brand a perpetual, royalty-free, worldwide license to use the approved video for marketing purposes.
• You will not submit content that is unlawful, defamatory, obscene, or that infringes any intellectual property rights.
• Payout is contingent on brand approval. ShopByVideo does not guarantee approval of any submission.

To receive payouts you must connect a Stripe account. ShopByVideo is not responsible for delays caused by Stripe's verification process.

6. Fees

ShopByVideo charges a platform fee of 10% of the total creator reward pool, plus Stripe's standard card processing fee (2.9% + $0.30), at the time of bounty creation. Fees are non-refundable except as required by law.

7. Content Standards

You may not submit or request content that:

• Is sexually explicit or pornographic.
• Promotes violence, hate speech, or discrimination.
• Violates any applicable law or regulation.
• Infringes any copyright, trademark, or other intellectual property right.
• Contains false or misleading information.

ShopByVideo reserves the right to remove any content and suspend any account that violates these standards without notice.

8. Intellectual Property

ShopByVideo retains all rights to the platform, its design, code, and branding. Nothing in these Terms grants you any license to use ShopByVideo's intellectual property.

9. Disclaimers

ShopByVideo is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that any specific result will be achieved from using it.

10. Limitation of Liability

To the maximum extent permitted by law, ShopByVideo's total liability to you for any claims arising from use of the platform shall not exceed the greater of (a) the fees you paid to ShopByVideo in the 12 months preceding the claim, or (b) $100.

11. Termination

Either party may terminate their account at any time. ShopByVideo may suspend or terminate your access for violation of these Terms, fraudulent activity, or any other reason at our discretion. Active bounty funds will be handled on a case-by-case basis.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the platform. Continued use after changes take effect constitutes acceptance of the new Terms.
